A topic on trademarks (Klonoa/HENSHIN)
« on: November 13, 2018, 04:40:05 pm »
I wasn't quite sure which topic to discuss this. Excuse me while I info dump here.

So you may or may not be aware of the strange happenings between HENSHIN and the Klonoa film. Namely, how we're pretty certain(?) it's still happening but HENSHIN deletes their tweets without rhyme or reason (that we're aware of anyways). Anyways, you can read up on all that in this topic: https://forums.untamedheart.us/?topic=1810.120

What's with HENSHIN's shakiness getting off the ground? Me, being the junior detective, thought that maybe some clues could be found in trademark filings for both the Klonoa and HENSHIN names.

https://trademarks.justia.com/875/64/henshin-87564591.html
HENSHIN's current status on this site states "654 - Report Completed Suspension Check - Case Still Suspended" as of June 6th, 2018. I really don't know anything about legal/trademark lingo but looking it up gave me this description:
Sorry but you are not allowed to view spoiler contents.

This may not be up to date but it might explain a little bit about their silence. Although, it should be noted they made a tweet AFTER this fact on July 25th, 2018 saying "Lots of updates on our projects coming in Q4. Hang tight!" only for the tweet to be deleted sometime in September.

There's also an older entry which I believe fell out of use because they switched office locations or something. I only figure this to be the case based on their (now deleted) facebook having a status saying they changed their address and one of the entries says "TEAS CHANGE OF OWNER ADDRESS RECEIVED". This one was last active in 2015 so this might not be relevant to anything Klonoa.

Again, I really can't say if this has any bearing on anything HENSHIN is supposedly doing or not. They've been around since 2014 but the only thing they've done in their name so far is be a sponsor for the GLAS Animation Festival (http://www.glasanimation.com/sponsorship/) which Rob Pereyda (the founder of HENSHIN by the way) attends every year.

Anyways, that's HENSHIN. What about Klonoa exactly? The Klonoa name has multiple entries. Here's one that might pertain to the Klonoa film:

It was late October 2016 we learned of the Klonoa films existence. The "AUTOMATIC UPDATE OF ASSIGNMENT OF OWNERSHIP" might refer to HENSHIN optioning the rights to develop the film with permission from NAMCO BANDAI. There's more on the optioning/development process here: https://en.wikipedia.org/wiki/Option_(filmmaking)

https://trademarks.justia.com/766/38/klonoa-door-to-76638022.html
There's a trademark for the "Klonoa: Door to Phantomile" name which was renewed June 23rd, 2016. However, although it's close to the time we learned about the film, it could very well be just a renewal of the trademark because the game currently remains downloadable on the Playstation Store.
The most recent status on this says "ATTORNEY/DOM.REP.REVOKED AND/OR APPOINTED" from May 30th, 2018 but I can't figure out what this even means.

https://trademarks.justia.com/776/99/klonoa-77699376.html
There is a second instance of the Klonoa name in the database but it's status is currently "606 - Abandoned - No Statement Of Use Filed" as on October 15h, 2012 which is around the time the webcomic was beginning. This one may have pertained to the Wii game as it's trademark was filed March 25th, 2009 close to the time the game came overseas simply titled "Klonoa". So we can probably ignore this one.

Lastly, is another entry for the "Klonoa: Door to Phantomile" name which went abandoned in 2009. I believe this one just pertains to the Wii game or downloadable version as well.

Sadly, maybe no concrete clues came from all this but I thought I'd put my thoughts down somewhere. Hitoshi Ariga and that (still kinda mysterious) @klonoa_anime twitter are honestly the current proof the Klonoa film is happening. I am trying to stay calm/patient but I like to investigate the strange happenings as well... because I can't help but feel concerned. Feel free to contribute or brush up on legal terminology... because I sure can't wrap my head around it all.

Found one that says it was renewed last year.

Also, I looked up that “attorney revoked/appointed” thing, and I found this.

Quote
What do ‘TEAS Revoke/Appoint Attorney Received’ and ‘Attorney Revoked And/Or Appointed’ mean? This means that an attorney has been changed (not necessarily revoked). The same form is used to appoint or revoke.

I'm gonna have to keep watch on this. Though I need to keep my self distant too until I know more of what is going on.
I don't know much of anything about how the trademark stuff works :(

I do wish this though from henshin. I would really wish they wouldn't say lots of updates coming and then go back on their word by deleting the tweet. Just post the update when it is ready. It doesn't always need a big buildup. I  have an extreme dislike of false hope and riled anticipation only for said source to backtrack on it.

I believe in Hitoshi Ariga getting the Klonoa anime/movie through one way or another somehow. It is about all I can hold on to until there is more news.

For the record, the tweet was deleted because the Henshin twitter account was Re-tooled into a twitter account for the Klonoa Anime Project (the Henshin account currently being used is a different one).

But said reasons for why they do so many deletions/switch-ups is still really weird. It's the silence after the fact that creates concern. I know the sole tweet from @klonoa_anime should have been enough to quell worries but everything else surrounding it still makes me uneasy. Therefore, I thought maybe there's some sort of legal issues occurring.

The whole thing about Henshin going silent all of a sudden and retooling their Twitter to be Klonoa centric comes of as, at least to me, them being too gung-ho about their projects altogether. Weren't they managing three drastically different things at once? There's a movie, a manga and then some sort of webcomic. If I recall correctly they kept bouncing their focus around and never seemed to really have enough staff to manage it all. If they were pouring money into what was practically nothing then that could explain the odd turn of events being due to lack of funds to keep standing.

This is just tinhatting though. But going from a good three projects to a stagnant single deal is a bit telling of how they are financially. Makes me wonder if this is even going to stick to being a movie at all.

Well. Hitoshi Ariga just said it’s still a thing on twitter.

I guess the reason I made this topic is because all this uncertainty is making me question what this project is even going to be anymore. I don't want it to be in this limbo-like state forever. If legal/money issues regarding the company are the issue that'd be a real shame. Wish they didn't delete all traces of the Klonoa movie off their twitter sans the news websites that reported on it. I don't know why they'd even do such a thing considering other people talked about it.

I think you should just stop worrying about this and pay attention to other things until we get some more news that isn’t “Don’t worry, It’s still a thing guys!” This film has just been wearing you down. I get the feeling of not knowing whether to be excited or not. But I think you’ve been stressing yourself out  for the past year over this.

Worrying about something you're passionate about never hurts. It's not like we're foaming and overly obsessing over it all day every day :bad_straight_face:

The whole situation is just mystifying. One day we get this huge announcement for a dead franchise then pop its public progress gone after months & months of near silence. Being curious about this kind of thing isn't bad and neither is researching for the fans' sake.
